Sunrise & Pioneers Period Rules of .公司 and .网络

Sunrise period is the first phase of the Top Level Domain ".公司" (xn—55qx5d) and ".网络"(xn--io0a7i) for their open registration. In this period, the Trademark Holders are provided the first right to register domain names whose trademark labels match their labels registered in Trademark Clearinghouse.

Pioneers Period is the second phase of the Top Level Domain ".公司" (xn—55qx5d) and ".网络"(xn--io0a7i) for their open registration. In this phase, trademark holders approved by China National Trademark Bureau, or other national or regional trademark examination and approval authority have the priority to register their domain names within the validity period of trademark.

CNNIC will not conduct ".公司" (xn—55qx5d) and ".网络"(xn--io0a7i) trademark verification after the Pioneers Period .

Part One Sunrise Rules

1.Registration Period

Sunrise of ".公司" (xn—55qx5d) and ".网络"(xn--io0a7i) starts from 0:00 on May 30, 2014 to 24:00 on July 30, 2014, lasting 62 days, which is split into:
1)Notice Period: May 30, 2014 to July 30, 2014 is the sunrise notice period. During which, CNNIC will not conduct any registration application;
2)Implementation period: July 1, 2014 to July 30, 2014 is open registration period. During which, only TMCH holders are entitled to submit registrations.
 
2.Registration Rules

1)Registrant Requirements
The domain name registrant must abide to the provisions of "Chinese Internet Domain Name Management Regulations" based on their TMCH verified qualification. The Trademark Holders should submit corresponding registration information, identity certificated materials and SMD files (Signed Mark Data files) provided by TMCH.

2)Material Requirements
Applied-for domain name;
Host name of main and secondary domain name servers;
If the applicant is an individual registrant, who needs to submit SMD, name, ID type, ID number, contact address, telephone, e-mail etc.;
If the applicant is on behalf of an organization, who needs to submit SMD, organization name, the type of organizational identity, organizational identity code, mailing address, e-mail, phone numbers, etc.;
Name of the domain admin contacts, technical contacts, domain billing contacts, and their mailing addresses, email addresses, phone numbers.

3)Identity certificated materials
In Mainland China: apart from the organization code and ID card number, any other identity information should be submitted with corresponding identity certificated materials;
Out of Mainland China: the identity certificated materials should be submitted in electronic forms.

Notes: All the above materials shoule be submitted before Beijing time 24:00 on July 30, 2014.

3.Domain Name Label Requirements

1)Naming Requirements:
Consist of Chinese simplified or traditional characters, letters A-Z, numbers 0-9 and hyphens;
not begin or end with a hyphen;
not exceed 63 characters( for non-ASCII label, this criteria is applied to the length of punycode transferred from Chinese label).
not exceed 20 Chinese characters
Characters (includes only the Chinese characters, letters or numbers in the trademark) in the trademark label of the TMCH holders should be in consist with the character of the domain name applied. E.g., domain abc.公司 could be recognized as abc.

2)Allocation rules:
Domain names will be registered on a "first come-first served" basis.

4.Dispute Solutions

Any challenges alleging that a domain name has been registered by improper registrant, or has been declined to be registered will be resolved by Sunrise Dispute Resolution Policy (the "SDRP"). Any SDRP complaint should be brought underSDRP before 120 days after the closeof the sunrise period.
Complaint raised from the SDRP will be handled in pursuant to Rules of Sunrise Dispute Resolution Policy.

5. Fees and Limitations
1)Domain registration fee in sunrise: RMB 1,800.00/Year;
2)Minimum registration years in sunrise: 5 years;
3)Renewal fee in sunrise: RMB 320.00/Year;
4)Registration fee is nonrefundable if the registrants or registrars delete the registration which has been submitted and passed audit successfully during sunrise.
5)Registration fee is refundable if the registration failed to pass audit.

Part Two Pioneers Period Rules

1.Pioneers Period
Pioneers Period starts from July 31, 2014 to August 20, 2014, length of 21 days.

2.Registration Rules

1)Application Requirements
The domain name registrant must abide to the provisions of "Chinese Internet Domain Name Management Regulations", in order not to violate the Chinese laws and regulations. All domain name registered during Pioneers Period shall be registered through an ICANN-Accredited Registrar and on a first come-first served basis.
Information about domain name and registrant cannot be modified after registration submitted. In the event of any modification, registrant should submit a new one and the final submission time should be deemed as the application time.

2)Registration Material Requirements:
The domain names applying for registration;
The host names of the main and secondary domain name servers for the domain name;
If the applicant is an individual registrant, who needs to submit name, ID type, ID number, contact address, telephone, e-mail etc.;
If the applicant is on behalf of an organization, who needs to submit organization name, the type of organizational identity, organizational identity code, mailing address, e-mail, phone numbers, etc.;
Name of the domain admin contacts, technical contacts, domain billing contacts, and their mailing addresses, email addresses, phone numbers.

3)Proof materials:
Identity certificated materials:
In Mainland China: rather than the organization code and ID card number, any other identity certificated information should be submitted with corresponding identity certificated materials;
Out of Mainland China: the identity certificated materials should be submitted in electronic forms.
Trademark materials:
In Mainland China: provide a scanned copy of trademark registration certificate
Out of Mainland China: submit the trademark information query screenshots made by trademark approval authority

Notes:
A.Relevant materials should be submitted between 50KB to 200KB with format jpg, jpeg, png or bmp.
B.All the above materials should be submitted before Beijing time 24:00 on August 20, 2014.

3.Naming Rules

1)Naming Requirements:
If a trademark contains any form of Chinese (pinyin), English or numbers, the registrant may apply for registering the corresponding domain label which is consistent with the trademark content. For example, the registrant has trademark containing a word"花朵"(meaning flower in English), the registrant may apply for the registration, for instance, "花朵.公司"or "huaduo.公司" or "花朵.网络" or "huaduo.网络", but cannot preferentially register the domain name in the form of "flower.公司".
Trademarks in mainland China are subject to the check and verification results from China National Trademark Bureau. Trademarks outside mainland China are subject to the verification results from local trademark approval authority. Any invalid trademark will be refused by CNNIC.
If the trade mark contains the polyphone, any pronunciation of the word can be used to register.
If the trademark is a purely figurative mark and unable to identify the corresponding vocabulary of words, it does not meet the requirements for priority registration.
Registrants and trademark holders should be the same person or organization. If they are different, the applicants are required to submit the trademark holder's proof of authorization documents and proof of identity materials, both of which should be with a stamp or signature.

2)Allocation requirements:
Domain names will be registered on a "first come-first served" basis.

4.Dispute Solutions

Within the Pioneers Period , the dispute arising from the conflict between any applicant’s domain name registration and trademark holders, must be resolved by complying with the Uniform Domain Name Dispute Resolution Policy established by ICANN (abbreviated: UDRP) or the Uniform Rapid Suspension Policy( "URS") constituted by ICANN.
The complaints filed according to UDRP will be solved in accordance with rules of http://www.icann.org/udrp/udrp-rules-24oct99.htm, and the supplementary rules published by administrative dispute resolution service providers specified by the users; the complaints filed according to the URS policy will be solved by, http://newgtlds.icann.org/en/applicants/urs, and the supplementary rules published by URS service providers specified by ICANN .

5. Fees and Limitations

1)Domain registration and renewal fee in Pioneers Period : RMB 320.00/Year;
2)Minimum registration years in Pioneers Period : 3 years;
3)Preferential measures:
Registration for 3-5 years, get another 1 year free;
Registration for 6-8 years, get another 2 years free;
E.g., the registrant will get an extra 2 years free registration with 6 years registration submission, thus the registrant will totally get a 8-year registration of the domain.
All the free domain renew operation will be conducted uniformly after the Pioneers Period.
4)Registration fee is nonrefundable if the registrants or registrars delete the domain which has passed audit and successfully registered during Pioneers Period.
5)Registration fee is refundable if the registration failed to pass audit.
